General terms and conditions of business

South Tyrol Rafting Expeditions Coop. Soc. Dill. Sports.

1st registration:

The registration of the activity can be made in person, by telephone or in writing. The registration is confirmed by Südtirol Rafting Expeditions in person, by telephone or in writing and is therefore binding.

If the content of the booking confirmation differs from the registration, we ask you to inform us immediately and submit a new offer. If we do not receive a confirmation, we assume that the information is correct and consider the booking as confirmed.

2. cancellation policy and payment:

Payment can be made by bank transfer or cash on the spot. If an invoice is required, please let us know in advance.

(Unless otherwise agreed, a 50% deposit is due on the account after the booking has been made).

The remaining 50% of the payment must have been paid into the above-mentioned account at the start of the tour.

You can withdraw from the reservation / booking at any time. In your own interest and to avoid misunderstandings, we strongly recommend that you declare your withdrawal in writing. As compensation for the preparations and expenses made, we must demand a percentage payment of the booking price, depending on the proximity of the cancellation date to the activity date, taking into account the following list

up to the 30th day before the booked date 20%, from the 29th day to the 22nd day before the booked date 30%, from the 21st to the 15th day before the booked date 40%, from the 14th day to the 7th day before the booked date 60%, from the 6th day before the booked date 90%, in case of cancellation or no-show on the day on which the activity should take place, 100%.

3. scope of services:

The scope of the contractual services can be found in the booking confirmation. In the absence of a written booking confirmation, the scope of services stated in the brochure and on the homepage applies. It is always the latest version of the brochures.

A date coordination with further individual or group bookings is possible, unless otherwise agreed (as in case of an exclusive departure).

4. services not used:

If the participant does not make use of individual services, there will be no refund (also no partial refund) of the payment made. If the event participant does not depart at the agreed time or does not depart on time, there is no right to a refund of the payment.

5. rebooking:

As far as possible, we try to make a rebooking possible for you even after the reservation. If this should result in additional costs for us, these are to be replaced.

6. condition of the participants:

The participant commits himself to inform the boat guide about possible physiological or physical impairments before the start of the tour (e.g. in case of allergies there is the possibility to take allergens on board).

Persons impaired by medication, alcohol or drugs are excluded from the activity. This also applies to mentally and physically unfit persons.
The boat driver can decide whether a person is not suitable for the activity (suspicion of alcohol or drug consumption is sufficient).

7. adventure activity:

Each participant is aware that he/she is taking part in an adventure and whitewater activity in nature that cannot offer the comfort and safety of a normal package tour. The equipment meets the latest safety standards. All tours are carefully planned and prepared. Before each tour an introduction and briefing is given by the tour leader or a staff member. The risks are manifold and therefore cannot be completely excluded (as with all outdoor activities). The liability for all damages and claims, regardless of the legal basis, against Südtirol Rafting Expeditions Soc. Coop. Sport. Dil. or its employees and boatmen, is limited to negligence or intent.

South Tyrol Rafting Expeditions Soc. Coop. Sport. Dil. is not liable for damages resulting from activities that go beyond the booked program. In the case of consumer transactions within the meaning of the Consumer Protection Act, this applies only to the extent that these damages do not concern personal injuries.

8. safety instructions and instructions:

The participant has to follow all safety instructions and instructions of the tour leader and the guides and has to actively participate in the tour. The participants must support each other.

9. withdrawal from the contract on our part:

The tour leader (boatman) is entitled to exclude guests from the tour or to cancel the tour if they violate the terms and conditions and especially if they do not meet the requirements necessary for the tour. The tour leader reserves the right to change, extend, interrupt or restrict the tour program due to unforeseen circumstances which may endanger the safety of the guests (e.g. too high water level, weather change, insufficient skills or insufficient attention of the participants, etc.). South Tyrol Rafting Expeditions Soc. Coop. Sports. Dil. is entitled to withdraw from the contract in case of such circumstances.

10. injuries and damages:

Injuries and damages are to be reported immediately to the tour leader / boatmen.

11. duration of the tours:

The information about the duration of the tours in the brochures, flyers and on the homepage are approximate values. The duration of the tours cannot always be exactly determined in advance. They are related, for example, to the water level or the group dynamics. South Tyrol Rafting Expeditions Soc. Coop. Sports. Dil. does not guarantee that these guide times will be adhered to.

12. place of jurisdiction:

Italian law applies. Place of jurisdiction and place of performance is the Provincial Court of Bolzano, Italy.

13. price or program changes:

Price or program changes and corrections of printing errors (on brochures, flyers and on the homepage) are reserved. Invalidity of individual provisions:
If one of the provisions of the travel contract is or becomes invalid in whole or in part, this shall not result in the invalidity of the entire travel contract. Rather, we are entitled to replace the ineffective provision with the permissible provision that most closely corresponds to the purpose of the ineffective provision.

14. exclusion of claims and limitation of time:

All claims due to non-contractual performance of the activity must be asserted to us in writing within one month after the contractually stipulated end of the trip. After the expiry of this period, you can assert claims if you were prevented from complying with the deadline through no fault of your own. All your claims from the travel contract expire in 6 months. The statute of limitations begins with the day on which the trip should end according to the contract. If you have asserted such claims, the statute of limitations is suspended until the day on which we reject the claims in writing.

15. swimming ability:

The activity requires adequate swimming ability in running water.

16. transportation of children:

Children under the age of 6 are not permitted on the tours. For the “Adventure”, or “Adventure Light”, a minimum age of 14 years applies. All minors must be accompanied by a suitable adult supervisor. The registration forms for the insurance must be signed by a parent or guardian (for groups we can send the registration forms in advance so that they can be read and signed by the parents).

South Tyrol Rafting Expeditions and its staff cannot be held liable for any misrepresentation regarding the age of the children.

17. gear:

The participant has to take care to take the equipment received from the base before the start into the busses and always carry it with him/her. Furthermore, he has to make sure that he is properly dressed with the equipment (as demonstrated by the boatmen). During the tour it is not allowed to take off the helmet or to open the chinstrap or the life jacket. The participant must always be properly dressed and fully equipped during the tour. If a participant is unsure whether he/she is properly dressed with the equipment or if for any reason he/she wants to change something on his/her equipment for a short moment (e.g. open the life jacket), he/she must inform the boatmen of this intention and then wait for and follow the permission and instructions of the boatmen.

The tour leader (boat guide) has the right to exclude the participant from the tour in case of incomplete or improper use of the equipment, if this circumstance is due to negligence of the participant.

18. inappropriate behaviour:

The descent takes place in a natural environment and the participant should treat it with respect. No rubbish should be left behind, unnecessary damage to plants and animals should be avoided. Smoking and unnecessary noise is prohibited during the descent.

19. damage:

For wilful damage to boats, equipment and any furniture of the base the participant / guest is liable.

20. assistance:

The passenger is obliged to assist in the transport of the boat and equipment from and to the transport vehicle.

21. from the bus to the boat:

During and during the activity the participants will be partially near roads and cycle paths. It is the participant’s own responsibility (in the case of minors, the parent or guardian) to exercise the necessary caution and not to block roads and cycle paths unnecessarily.

Furthermore, the participant has to take special care when getting in and out of the boat, because shallows, slippery stones, different current conditions and moving of the boat are to be expected, which increases the risk of injury.

22. valuables:

No liability is accepted for valuables. Should a participant take any objects (cameras, cameras, mobile phones) with him/her to the departure, he/she must inform the tour leader and the boat guides before departure. South Tyrol Rafting Expeditions is not liable for any items brought to the activity by participants that are not part of their equipment, and no refunds are possible.
We also advise not to bring jewellery and watches to the departure.
